Islamabad High Court Upholds Arbitration Clause in Power of Attorney: Significant Ruling on Section 34 of the Arbitration Act
We are proud to announce a recent victory by our firm in a critical arbitration matter under Section 34 of the Arbitration Act, heard before the Islamabad High Court. The court ruled that an arbitration clause, even if included solely within a Special Power of Attorney and not explicitly in the agreement to sell, is sufficient to bind the parties involved. This ruling reinforces the importance of honoring arbitration agreements and highlights the court's pro-ADR stance.
In its judgment, the Islamabad High Court emphasized that 'Section 34 of the Act has been enacted to make arbitration agreements effective and prevent a party from going to the Court contrary to his/its own agreement.' The court further affirmed that the cancellation of the Power of Attorney after the arbitration proceedings had concluded does not affect the binding nature of the arbitration, underscoring the sanctity of contractual commitments.
Additionally, the court noted that 'the powers vested in the court to grant stay under Section 34 of the Act are entirely a matter of discretion of the court,' underscoring the growing judicial preference for arbitration over traditional litigation.

In a recent landmark judgment, the Lahore High Court has established significant principles regarding the issuance of show cause notices, providing clarity on jurisdictional errors, the role of constitutional jurisdiction under Article 199, and the importance of adhering to statutory forums.
Key takeaways from the judgment include:
A show cause notice is not considered an adverse order unless it is clearly demonstrated that it was issued by an authority lacking jurisdiction or for mala fide reasons.
Jurisdictional errors do not encompass every mistake; a wrong exercise of jurisdiction or misinterpretation of the law does not equate to a lack of jurisdiction.
Constitutional jurisdiction under Article 199 is only invoked if the person is deemed an 'aggrieved party' and no adequate statutory remedy is available. The existence of statutory remedies must be considered when exercising discretion under this Article.
The bypassing of statutory forums should be discouraged to maintain the integrity of legislative intent.

We are honored to share a recently reported judgment by hon'ble Justice Babar Sattar in which our Partner Barrister Talha Ilyas Sheikh had the privilege to be a part of. This significant ruling decides the jurisdiction of the Intellectual Property Tribunal, Islamabad, resolving long-existing uncertainties.
In this case, the High Court held that the Intellectual Property Organization of Pakistan Act, 2012, supersedes the conflicting provisions of the Trade Marks Ordinance, 2001. This decision is pivotal in ensuring that all suits and other civil proceedings regarding the enforcement of Intellectual Property Laws, including applications for revocation/invalidity of trademarks, are to be instituted and decided exclusively by the Tribunal.
